EternaGlow - Terms of Service

Welcome to EternaGlow. By accessing, browsing, or purchasing from eterna-glow.com (the “Site”) you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Site or purchase products.

1. Acceptance of Terms

EternaGlow may modify these Terms at any time. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

2. Eligibility & Account Security

You represent that you are at least 18 years old (or the age of majority in your jurisdiction) and have legal capacity to enter these Terms. You are responsible for all activity associated with your account and for maintaining the confidentiality of account credentials.

3. Orders & Acceptance

All orders are subject to verification and acceptance by EternaGlow. We may refuse or cancel orders for any reason including suspected fraud, incorrect information, or stock unavailability. Acceptance of an order occurs when we ship the product.

4. Product Use, Safety & Medical Disclaimer

Our products (including but not limited to LED light therapy masks) are intended for cosmetic/beauty use as described on the Site. Do not use the product contrary to the included instructions. The product is not a substitute for professional medical advice, diagnosis, or treatment.

By purchasing you confirm you have read and will follow the user manual and safety warnings. EternaGlow is not responsible for harm or injury resulting from misuse, modification, improper cleaning, unauthorized repairs, failure to follow instructions, or use with incompatible accessories.

5. Pricing, Payment & Taxes

Prices shown at checkout are final for the order. Customers are responsible for any currency conversion fees, bank charges, customs duties, import taxes, and similar charges. We may change prices at any time.

6. Shipping & Risk of Loss

Estimated shipping times are estimates only. Title and risk of loss for products pass to you upon delivery to the carrier. Inspect all packages upon receipt and report any damage to the carrier and EternaGlow immediately.

7. Returns & Refunds

Returns and refunds are governed by our separate Return & Refund Policy. Unauthorized returns may be refused. Any returned product must be in accordance with the conditions and timeframes in that policy.

8. No Warranties; Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ETERNA GLOW DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, OR NON-INFRINGEMENT. PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL ETERNA GLOW, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR: (A) INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; (B) LOST PROFITS, LOSS OF GOODWILL, LOSS OF USE, LOST DATA, OR BUSINESS INTERRUPTION; OR (C) ANY CLAIMS ARISING FROM THIRD‑PARTY PRODUCTS OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability to you for any claim relating to your purchase, these Terms, or the Site is limited to the purchase price actually paid by you for the product that directly gave rise to the claim. Some jurisdictions do not permit limitations of liability for personal injury - where such laws apply, liability will be limited only to the extent permitted by law.

10. Indemnification

You agree to defend, indemnify, and hold harmless EternaGlow and its affiliates and representatives from any claim, demand, liability, loss, damages, or expenses (including reasonable attorneys’ fees) arising out of: (a) your use of the Site or purchase of products; (b) your violation of these Terms; (c) your violation of any third‑party rights; or (d) your negligent or willful misconduct.

11. Prohibited Uses

You may not use the Site or our brand for illegal, fraudulent, abusive, or unsolicited promotional activities. Prohibited activity includes but is not limited to uploading malware, scraping content, or misusing our trademarks.

12. Intellectual Property

All Site content, branding, images, and materials are the property of EternaGlow or its licensors and are protected by law. You may not reproduce, distribute, or create derivative works without our written permission.

13. Affiliate Program

Affiliate participation is subject to a separate Affiliate Agreement. We may terminate affiliate accounts for any reason. Affiliates are independent contractors and responsible for taxes and fees. Commissions are paid only on completed, non‑refunded sales.

14. Dispute Resolution; Arbitration; Waiver of Class Actions

To the maximum extent permitted by applicable law, any dispute arising from or relating to these Terms will be resolved through final and binding arbitration rather than in court, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property or confidential information.

You and EternaGlow further agree to waive any right to a trial by jury and to bring or participate in any class, collective, or representative action.

15. Governing Law & Venue

These Terms are governed by the laws of the jurisdiction in which EternaGlow operates, without regard to conflict of law provisions. Any non‑arbitrable claims will be brought only in the courts located in that jurisdiction; by using the Site you consent to personal jurisdiction and venue there.

16. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

17. Changes to Terms

We may update these Terms at any time. We will post the revised Terms on the Site and indicate the date of last revision. Continued use after posting constitutes acceptance.
